WHAT IS THE FAMILY LAW PROPERTY CALCULATOR
The Family Law Property calculator is a tool developed from an analysis ofFamily Court and Federal Magistrates Court decisions relating to family law property settlements.
By working on the analysis of those cases formulae have been developed which provide an indication of the potential outcome in court based on an averaging of the examined cases.
Questions have been devised in order to assist people—lawyers or not—to complete the calculator.
The answers provided are fed into the formulae
The calculator produces a summary of the information inserted with a predictive indicator of the outcome in both percentage and dollar terms.
This summary and predictive indicator is able to be printed out.
HOW ACCURATE IS THE CALCULATOR
Family law property divisions are not an exercise in maths and so do not allow a strict mathematical assessment.
Each case requires assessment of evidence and the application of numerous discretionary factors
The calculator CANNOT determine what any particular judge may do in the particular circumstances.
Each judge will accept some evidence and reject some.
Each judge will apply his/her own perception of what is just and equitable in respect of the discretionary factors and on an overall assessment.
What the Calculator does is provide a tool that gives an indication of what courts—on average—have been doing and how they have been applying the various discretions.
If a best case—worse case assessment is done it will provide a good indicator of the predicted range that a court may come to if the matter went to trial.
The Calculator DOES NOT replace the advice of a good, experienced Family Law practitioner, since each case will in some ways go outside the boundaries of the average and there may be specific special circumstances that need to be taken into account.
The calculator formulae are updated regularly as new case law decisions require these formulae to be adjusted.
If the answers inserted were accepted by a Court then the Calculator will provide a good working indication of the potential outcome of a property dispute that ends up in a trial.
Given that all property advice must allow a 15% variation the Calculator will give a midrange indication of the potential outcome.
It provides a good forensic tool in assessing the prospects attainable at trial as against the legal and other costs of proceeding down the litigation path.
